1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and ALL WIN FINANCE GROUP PTY LTD, operating the Easy Loan brand (“Easy Loan”, “we”, “us” or “our”). They apply to your use of our website, mobile application, member portal and related services (together, the “Services”).
By accessing or using the Services, creating an account or submitting an enquiry, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional written terms may apply to a particular product, application, promotion or service. If there is an inconsistency, those additional terms apply to that extent.
2. Our Services
Easy Loan provides digital tools and support for loan and property-related enquiries, applications, communications, account management and member features. Some Services allow you to provide information to a finance professional, lender or other third party.
The availability, eligibility, rates, fees, conditions and approval of any loan or third-party product are determined by the relevant provider and may change. Use of the Services does not guarantee that an application will be accepted, that finance will be available or that a particular outcome will be achieved.
3. Eligibility and accounts
You must be at least 18 years old and legally capable of entering an agreement to use account, application or transaction features. If you use the Services for an organisation or another person, you represent that you have authority to act for them and bind them where relevant.
You agree to:
- provide complete, current and accurate information;
- keep your login credentials and verification codes secure;
- not allow another person to use your account without authority;
- promptly update account details that change; and
- notify us promptly if you suspect unauthorised access or activity.
You are responsible for activity through your account to the extent permitted by law. We may request information reasonably needed to verify your identity, authority or eligibility.
4. Acceptable use
You must not use the Services to:
- break any law, infringe another person's rights or facilitate fraud or deceptive conduct;
- submit information or documents that are false, misleading, unlawfully obtained or not yours to provide;
- access another account, system or data without authorisation;
- introduce malware, disrupt security or place an unreasonable load on the Services;
- scrape, copy, reverse engineer or bypass technical restrictions except where the law expressly permits it;
- send spam, harass another person or distribute harmful, offensive or unlawful content; or
- use automated means to access the Services without our written permission.
5. Your information and content
You retain ownership of information, documents and other content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit and display that content only as reasonably necessary to operate, secure and provide the Services and complete the requests you make.
You represent that you have all rights and permissions needed to provide the content and that doing so does not breach law, confidence, privacy or third-party rights. Our handling of personal information is described in our Privacy Policy.
6. Financial information and decisions
General information available through the Services is provided for convenience and does not take into account your objectives, financial situation or needs. It is not legal, tax, accounting or financial advice unless we expressly state otherwise in a separate written engagement.
You should check information independently, consider whether a product is appropriate for you, review the provider's disclosure documents and obtain professional advice where appropriate. Final product terms are those issued by the relevant provider. You are responsible for reviewing them before accepting a product.
7. Third-party services
The Services may link to or interoperate with lenders, payment providers, property services, Google services and other third-party platforms. Third parties operate under their own terms and privacy policies. We do not control and are not responsible for their content, availability, security or conduct, except to the extent responsibility cannot be excluded by law.
Google is an independent service provider. Easy Loan is not sponsored by, endorsed by or affiliated with Google merely because a feature uses Google Sign-In, Maps, Places or another Google service.
8. Fees and payments
We will disclose any fee payable to us for a Service before you incur it or in a separate agreement. You authorise us and our payment provider to process applicable charges and agree to provide accurate billing information. Third-party providers may charge separate fees under their own terms. Except where required by law or stated in the applicable offer, paid fees are non-refundable once the relevant Service has been supplied.
9. Intellectual property
We and our licensors own the Services, including their software, design, text, graphics, logos and other content, excluding content you submit. We grant you a limited, personal, revocable, non-exclusive and non-transferable right to use the Services for their intended purpose in accordance with these Terms.
You may not reproduce, distribute, adapt, publicly display, commercially exploit or create derivative works from our content without permission, except where permitted by law.
10. Availability and changes
We may maintain, update, add, remove or change features from time to time. We do not promise that the Services will always be available, uninterrupted or error-free. We may impose reasonable usage limits or temporarily restrict access for maintenance, security, legal or operational reasons.
We may update these Terms. The current version will be posted here with a revised “Last updated” date. If a change materially affects your rights, we will provide reasonable notice where required. Your continued use after the change takes effect constitutes acceptance to the extent permitted by law.
11. Disclaimers
To the extent permitted by law, the Services and their content are provided on an “as available” basis. While we aim to provide accurate and useful information, we do not warrant that every item is complete, current, suitable or free from errors. Property, market, rate and product information can change and should be independently verified.
Nothing in these Terms excludes any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
12. Liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special or consequential loss, or for lost profit, revenue, opportunity, goodwill or data, arising from the Services. This limitation does not apply where liability cannot be limited by law or to loss caused by fraud, wilful misconduct or a failure to exercise due care where the law requires it.
Where a statutory guarantee applies and the law permits us to limit a remedy, our liability is limited, at our option, to supplying the relevant Service again or paying the reasonable cost of having it supplied again.
13. Suspension and termination
You may stop using the Services at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate access where we reasonably believe you have materially breached these Terms, created a security or legal risk, used the Services fraudulently, or where suspension is required by law.
Where appropriate, we will give notice and a reasonable opportunity to address the issue. Provisions that by their nature should continue, including intellectual property, disclaimers, liability and governing law, survive termination.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Easy Loan submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them. Nothing in this section limits rights you may have under mandatory consumer law in another jurisdiction.
15. General terms
If part of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remainder will continue. A delay in enforcing a right is not a waiver. You may not transfer your account or rights under these Terms without our consent. We may transfer these Terms as part of a restructure or business transfer, subject to applicable law and your privacy rights.
